These terms govern your use of the SmartServe website at smartserveai.uk and other public pages operated by SmartServe AI Ltd.

By accessing or using the website, you agree to follow these terms. If you do not agree, you should stop using the website.

These are website terms only. Paid SmartServe services supplied to restaurants and venues are governed by a separate written Service Agreement and, where applicable, a Data Processing Agreement.

3. Purpose of the website

The website provides general information about SmartServe, its restaurant-booking platform and related venue-management services.

Website content is provided for general information only. It does not constitute legal, financial, accounting or other professional advice.

Product descriptions, screenshots, feature information and pricing explanations may be updated as the service develops. A restaurant customer's signed agreement will take priority over general website content if there is any inconsistency.

4. Acceptable use

You may use the website only for lawful purposes. You must not:

  • use the website in breach of any applicable law or regulation;
  • attempt to gain unauthorised access to the website, platform, accounts, servers or databases;
  • introduce viruses, malicious code or other harmful material;
  • interfere with the operation, security or availability of the website;
  • attempt to test or circumvent security controls without written permission;
  • use automated tools to overload, scrape or extract website content in a harmful or unreasonable way;
  • impersonate another person, venue or organisation; or
  • use the website to transmit unlawful, misleading, abusive or fraudulent material.

Some SmartServe services require an authorised staff account. Account holders must provide accurate information and keep passwords and authentication credentials secure.

You must not share access with an unauthorised person or use another person's account. Contact SmartServe promptly if you believe an account has been compromised.

We may suspend access where reasonably necessary to protect users, venues, personal information or the security and integrity of the service.

6. Restaurant bookings and deposits

SmartServe provides technology that enables restaurants and venues to receive and manage bookings. Unless expressly stated otherwise, the restaurant service itself is provided by the relevant venue, not by SmartServe.

A booking may be subject to the venue's own availability, cancellation, deposit, refund, dining, age, accessibility and other policies. You should review any venue-specific terms shown during the booking process.

Venues are responsible for the accuracy of their availability, opening hours, menus, allergen information, booking rules and service information.

Where a deposit is required, payment-card information is processed securely by Stripe. SmartServe does not receive or store complete card details.

Questions about a specific booking, restaurant service, cancellation or refund should normally be directed to the relevant venue.

7. Intellectual property

The website, SmartServe platform, software, branding, logo, design, text, graphics, interfaces and other original content are owned by SmartServe AI Ltd or used under licence.

You may view and use the website for legitimate personal or business evaluation purposes. You must not copy, reproduce, modify, distribute, sell, license, reverse engineer or commercially exploit our content or software unless permitted by law or authorised by us in writing.

SmartServe, SmartServe AI and associated brand elements may not be used in a way that suggests endorsement, partnership or affiliation without written permission.

8. Website availability

We aim to keep the website and services available and secure, but we do not guarantee uninterrupted, error-free or permanent access.

We may update, suspend, restrict or withdraw any part of the website for maintenance, security, operational or business reasons.

You are responsible for ensuring that your devices, software and internet connection are suitable and appropriately protected.

9. Third-party services and links

The website and SmartServe services may contain links to or integrations with third-party services, including restaurants, payment providers and communication providers.

Third-party services are operated under their own terms and privacy policies. We do not control and are not responsible for unrelated third-party websites or their content.

A link does not necessarily mean that SmartServe endorses every statement, product or service on the linked website.

10. Responsibility and liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot legally be excluded or limited.

The public marketing website is provided without charge. To the fullest extent permitted by law, we do not accept responsibility for loss caused solely by reliance on general website content, temporary website unavailability or third-party websites outside our control.

SmartServe is not responsible for the quality, safety or delivery of restaurant services supplied by an independent venue.

Liability relating to paid SmartServe services supplied to a restaurant or venue will be governed by the separate agreement between SmartServe and that customer.

Nothing in these terms affects any mandatory statutory rights you may have as a consumer.

11. Privacy

Our Privacy Policy explains how SmartServe collects, uses, stores and protects personal information.

A restaurant using SmartServe may also provide a separate privacy notice explaining how it uses guest information as a data controller.

12. Suspension and enforcement

We may restrict or suspend access where we reasonably believe these terms have been breached or where action is necessary to protect the website, platform, customers, users or personal information.

Serious misuse may be reported to the relevant customer, service provider, regulator or law-enforcement authority where appropriate.

13. Changes to these terms

We may update these terms when the website, our services or applicable laws change.

The latest version will be published on this page with its revision date. Continued use of the website after an update means that the updated terms apply to subsequent use.

14. General provisions

If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

A delay in enforcing a right under these terms does not mean that right has been waived.

These terms do not create a partnership, agency, employment or joint-venture relationship between you and SmartServe.

15. Governing law
